The Supreme Court on Monday described as "premature" a PIL challenging the move to create a separate Telangana state.


Dismissing the PIL as withdrawn, a Supreme Court bench headed by Justice HL Dattu said there were several steps to be taken before a separate state of Telangana becomes a reality.

The court also said that when the proposal goes before Parliament, it may or may not be accepted, indicating that it was too early for it to entertain such a plea.

Lawyer PV Krishnaiah had filed a petition challenging the move to divide Andhra Pradesh.

In his petition, he mentioned that according to Article 371(D) of the Constitution, Andhra Pradesh has got special status and powers which doesn't allow splitting of state for  political aspirations.
Only Parliament has the responsibility to divide the states, the Court said.

Krishnaiah said that as per the Supreme Court direction, he would withdraw the petition. However, he has decided to file the same in the High Court.

Earlier in the day, the Andhra Pradesh High Court too dismissed a petition challenging the division of AP.
The court dismissed the petition stating that the matter did not deserve hearing as the decision was yet to come from the Centre.
