Jagan bail plea adjourned to Nov 28
Hyderabad: The Nampally Special CBI Court which is hearing the two bail pleas filed by
YSR Congress Party president YS Jagan Mohan Reddy adjourned the case to Nov 28.
Jagan Mohan Reddy had filed two petitions last week seeking bail one a statutory plea under Section 167 (2) CrPC and the other a regular petition under Section 437 of the CrPC.
After hearing the arguments presented by lawyers from the CBI and those representing Jagan Mohan Reddy, the judge adjourned the case to Nov 28.
Both the parties argued only on the statutory bail petition filed under section 167 (2).
In his argument counsel for Jagan Padmanabha Reddy said that “Jagan was entitled to statutory and mandatory bail under the section as the statutory period of 90 days
imprisonment was over.
“The CBI has not been able to complete its investigation in the prescribed period and the accused cannot be punished for that,” Padmanabha Reddy said. Jagan’s counsel also said that Sec 167 (2) is specifically meant for the release of the accused even if the investigations are inconclusive.
The CBI counsel Balla Ravindranath in his argument said that the petitioner was trying
to bypass the Supreme Court order passed on his bail plea recently.
To this Jagan’s lawyer said that in “we never went before the SC for bail under Sec 167 (2) as the 90 day period had not lapsed by then”.
