IPC Sec 409 not applicable to Jagan: Court - Sakshi Post

Jagan's assets case has taken an interesting turn on Tuesday as the Nampally Special Court admitting the CBI charge-sheet on Dalmia Cements, asked CBI to remove two sections clamped against Kadapa MP YS Jagan Mohan Reddy.

The CBI in its charge-sheet mentioned that Jagan had violated the criminal breach of trust. The court also said that IPC Section 409  (Criminal breach of trust by public servant) and Section 12 of the Prevention of Corruption Act were not applicable to Jagan as he was not a government servant. The court observed that there was no evidence to prove the charges leveled against the Kadapa MP.

Earlier, Jagan's lawyers had argued that the CBI had deliberately levelled baseless allegations against the YSRCP president without proof and also stressed that the two sections did not apply to him. Now the court ruled the same after examining the CBI charge-sheet.
