Demolish Illegal Structures Without Regularization: HC Directs GHMC
Hyderabad: The Hyderabad High Court on Tuesday ordered for demolishing all the illegal constructions, which are not eligible under Building Regularization Scheme (BRS). The High Court has directed the Greater Hyderabad Municipal Corporation (GHMC) to consider applications only of eligible applicants under the Building Regularization Scheme. GHMC should list out all the ineligible applications under BRS and pass final orders to owners of illegal structures before taking steps for demolition of illegal structures.
The Hyderabad High Court advised GHMC not to communicate the final orders to eligible applicants. The final orders are to be sent only to ineligible applicants to take further steps.
Ineligible applicants are those whose constructions have encroached on tank beds, nalas or public places, those who do not have permissions and who have violated the sanctioned plan beyond the permissible limit of 10 per cent.
A division bench comprising acting Chief Justice Ramesh Ranganathan and Justice A Shankar Narayana partly modified its earlier interim orders granted on a petition filed by the Forum for Better Hyderabad, challenging the building regularization scheme.
