HC Lifts Stay On Sujana Group Directors, Arrest Likely

Hyderabad: A vacation bench of Telangana high court, comprising Justice MS Ramachandra Rao and Justice A Rajasheker Reddy, vacated the stay imposed on likely arrest of directors of three companies belonging to the Sujana group on Wednesday.

The shell companies floated by the group had challenged the provisions of the GST Act in the Supreme Court which had refused to grant relief to the directors. The plea came up for hearing before a vacation bench of Chief Justice Ranjan Gogoi and Justice Aniruddha Bose. The apex court said it was not inclined to interfere with the April 18 judgement of the Telangana high court and dismissed the SLP accordingly.

The matter was brought to the notice of the High Court by the Additional solicitor general K Nataraj and GST wing counsel. Based on the order of the Supreme Courth the HC bench said the order of the apex court was binding and vacated the stay on their arrests while hearing the petition and posted the matter the month of June.

It may be recollected that on April 18, the Telangana high court had said it was not inclined to grant relief against arrest to the petitioners who had approached it challenging the summons issued by Superintendent (Anti-Evasion) of the Hyderabad GST Commissionerate under the Central Goods and Services Tax Act, 2017 and invocation of penal provisions under the law.
