Major Blow to TDP-backed Amaravati Farmers in Allotment of House Sites in R5 Zone Case
New Delhi/Amaravati: The Supreme Court on Monday refused to stay an order of the Andhra Pradesh High Court that had allowed the State government to allot house sites to nearly 50,000 poor families. The court also decided to transfer the case to the bench which is hearing the Amaravati capital case.
The apex court heard a batch of special leave petitions (SLPs) filed by the farmers of the Amaravati Capital Region. Senior Advocates Harish Salve, Mukul Rohatgi, Shyam Divaan and Devadatt Kamat argued on behalf of the farmers in the case. The farmers and the TDP leaders had approached the top court challenging the High Court order on R5 zone.
YS Jagan-led state government has issued a GO for distribution of house site pattas to non-locals and low income residents in the R5 zone. However, the farmers backed by the TDP opposed the government’s move and petitioned against it in the AP High Court. The high court heard the matter and dismissed their writ petitions paving the way for allotting house sites to the weaker sections and non-locals.
The state government had amended the APCRDA Act to provide house sites to the poor people. The GO enables the CRDA Commissioner to transfer 1,135 acres of land in Amaravati to the Collectors of Guntur and NTR districts.
The R-5 zone in the capital region will be bounded by Krishnayapalem, Nidamarru, Kuragallu in Mangalagiri mandal, and Manddam and Ainavolu villages in Thullur mandal. .
