Kajal Agarwal Fined For Filing False Case In Court
Chennai: South Indian actress Kajal Agarwal has suffered a setback in the Madras High Court after a suit filed by her in a copyright related case was dismissed by the court.
Kajal filed a petition in the court alleging that the haircare company — VVD & Sons Pvt. Ltd has been misusing her image for promoting its products including coconut oil, even after termination of the contract period. The actress demanded Rs 2.5 crore as compensation.
However, Justice T. Ravindran noticed that the company had not violated any rights of the actress and dismissed the suit.
According to the details, Kajal had entered into an agreement with the VVD for an ad-film to promote the VVD products from 2008 to 2009. However, the the actress argued that the VVD has been violating the agreement by using the ad-film to promote its products.
Denying the allegation, the VVD company contended that it owned the copyrights of the ad-film and used it extensively to promote its products. The VVD counsel argued that the actress had no right over the advertisement (ad-film) as she was paid the sum of Rs 3 lakh for acting in the ad-film.
As per the law, the copyright of the commercial is vested with the owner of the VVD. According to the Copyright Act, the term of the commercial cinematography film is 60 years. The actress was also asked to pay the VVD company for expenses it incurred for going to court.
