Hyderabad HC Reserves Verdict On GO 123 For Monday
Hyderabad: The Hyderabad High Court on Friday reserved the judgment on GO 123 for Monday. A Division Bench completed hearing on appeal by Telangana government on GO 123, which was earlier scrapped by the HC.
Telangana Advocate General (AG) had informed the Bench that the Telangana government will take care of agriculture laborers and rehabilitating land oustees as per the rules and regulations on land acquisition for Mallanna Sagar project.
High Court has directed Advocate General to furnish all these details in an affidavit and submit to the court.
Justice Suresh Kumar Kait of Hyderabad High Court on Wednesday quashed the GO:123 issued by Telangana Government.
Telangana Advocate General (AG) had informed the Bench that the Telangana government will take care of agriculture laborers and rehabilitating land oustees as per the rules and regulations on land acquisition for Mallanna Sagar project. High Court has directed Advocate General to furnish all these details in an affidavit and submit to the court.
The GO 123 facilitates quick acquisition of lands from land owners for public purpose.
However, the High Court has observed that the GO bypasses The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 ( Act 30 of 2013) and reminded that the government is not a private property dealer.
The court was allowing a writ petition filed by Tukkamma and 22 other agricultural labourers of Bardipur village, Jarasangham Mandal, Medak district.
The petitioners contended that the government is acquiring lands in this area including their village for National Investment and Manufacturing Zone (NIMZ) to be set up by the Telangana State Industrial Infrastructure Corporation (TSIIC).
