Data Leak: HC Sends Notices To AP, EC And UIDAI
Hyderabad: Notices were issued to the state of Andhra Pradesh, its Chief Electoral Officer (CEO), CEO of Unique Identification Authority of India (UIDAI) and its AP Registrar by Justice Shameem Akthar of the Telangana High court on Wednesday.
Notices were issued asking for their stand on a petition that the CEO of IT grids Ashok Dakavaram pleading to quash the FIR registered against him and his company by the Telangana Police.
“Although AP is contending that data was not stolen, the relevant authorities to clarify the matter would be the AP authorities, the Election Commission (EC) and the Aadhaar wings,” said Dakavaram’s counsel Sidhartha Luthra, and made these authorities respondents to his case.
“Criminal procedure was amended to enable victims to intervene in the case. As the data alleged to have been stolen belongs to EC and Aadhaar departments, their entry would clear the air,” he said.
The judge has asked them to respond to the case by April 22. S Niranjan Reddy, a senior Counsel appearing for Lokeshwar Reddy who is the complainant in the case, said that by merely bringing the EC and the UIDAI, the conspiracy in the case cannot be unraveled.
They are only custodians of the data. The victims are the people of AP,” he said. “Dakavaram is not revealing how he got the data,” he added while also mentioning that the case filed by Ashok is non-maintainable.
The judge has said that on the next hearing on April 22, he will look into the case’s maintainability as well as its merits.
